Deputy District Attorney Victor Avila told the court that Pursehouse had been waiting for Amie for four hours with the intention of killing her. “With his strength, he threw her over the balcony,” said DA Avila, noting that Pursehouse weighs nearly 100 pounds more than Amie.
Defense lawyers countered by claiming DNA evidence may have been contaminated and could not be dated. They also argued that the confrontation between Gareth and Harwick a month before the murder did not prove that he wanted to harm her.
According to them, Pursehouse had no intention of killing Amie. “There is no evidence that she was thrown from the balcony,” argued Robin Bernstein-Lev. “They are asking this court to speculate.”
Judge Michael E. Pastor sided with the prosecution, ordering Gareth Pursehouse to stand trial for her murder. Pursehouse’s attorneys appealed, insisting that accursed DNA samples collected from Ms Harwick’s fingernails and home could not be dated.
