Polk County, Florida – Daniele Hamilton has been arrested and charged with the murder of Kevin Berry in a road rage shooting incident that occurred on October 15, 2023. The incident took place on the I-4 off-ramp to US Hwy 27 in Davenport, Florida.
Kevin Berry, resident of Altamonte Springs, Florida, was involved in a confrontation with another driver on the off-ramp while on his way to work in Polk County. Witnesses reported the argument, stating that both Berry and the unidentified person in another vehicle were yelling at each other. During the altercation, Berry was shot and was later found lying on the ground outside his truck. He was taken to a nearby hospital but succumbed to his injuries on October 17, 2023.

Daniele Hamilton, a 58-year-old resident of Davenport, was arrested on Tuesday, October 17, 2023, and charged with second-degree murder, discharging a firearm from a vehicle, shooting over a right-of-way, and tampering with evidence.
Detectives gathered information from the scene and surrounding areas, including surveillance footage. They subsequently located Hamilton’s residence and questioned him. Initially, Hamilton denied any involvement and claimed to be a witness to the road rage incident. However, during the execution of a search warrant, detectives found a .38 special handgun and spent round casings in Hamilton’s bedroom trash. After this discovery, Hamilton allegedly stated, “You’ve found what you need to find so we can go [to jail].” He was then taken into custody without incident and booked into the Polk County Jail.
Hamilton has a prior criminal history with multiple arrests dating back to 1986, including charges such as disorderly conduct, contempt of court, drug-related offenses, forgery, counterfeiting, and robbery (downgraded to larceny).
The investigation into the incident and Hamilton’s charges will likely continue as the legal process unfolds.
