Michael Oher, a retired NFL player whose life story was the starting point for the Oscar-winning documentary “The Blind Side,” contends that during the past 19 years, he has not received any form of payment for the use of his name, image, or likeness. During that period, he asserts, his conservators—whom he initially believed to be his adoptive parents—”flagrantly disregarded their statutory and fiduciary duties” to him.
This is the latest development in the offensive lineman’s lawsuit against the Tuohy family, who Oher claimed in court papers last week of tricking him into a conservatorship as opposed to adopting him when he was 19 and supposedly taking millions of dollars for a Sandra Bullock-starring 2009 movie.
Martin D. Singer, the attorney for Sean and Leigh Anne Tuohy, returned to the lawsuit last Thursday and stated that Oher had frequently attempted to extort $15 million from the pair.
The legal team for the 37-year-old athlete submitted an application to compel accounting from Leigh Anne and Sean Tuohy in Tennessee probate court on Monday. They asked for a response within two weeks. In the document, which The Times was able to get on Tuesday, Oher accused the couple of using their ward—whom they had long described to as their foster son—for their commercial and marketing endeavors without receiving his complete knowledge.
“Co-Conservators have failed to timely file a single accounting for the past 19 years and have failed to file the first accounting [within seven months of their 2004 appointment]. The argument claimed the Tuohys of a “failure to uphold their financial duty” to do so, noting that “the Court nowhere granted an extension to the deadline for doing so.”
Oher’s attorneys contended that since it was a result of this failure, the athlete “was barred from knowing the full extent of any contracts negotiated on his behalf by his Co-Conservators,” especially the agreement reached alongside what was then 20th Century Fox in 2006 for Michael Lewis’ book “The Blind Side: The Evolution of the Game.” The book was written by a boyhood friend of Sean Tuohy, and it was turned into a John Lee Hancock movie with
