The judge in the case announced Monday that a former gynecologist who has been accused of sexually abusing more than 200 patients over the course of decades will receive a 20-year prison sentence.
Judge Richard Berman described Robert Hadden’s conduct as “lewd, egregious, out of control, depraved, extraordinary” and the case was “unlike any other”. Hadden is a former doctor who worked at Columbia University. In addition, Berman said he will sentence Hadden, 64, to lifelong supervision upon his release. When the hearing ends on Tuesday, the verdict will be decided.
Hadden is accused of sexually abusing patients during their planned gynecological examination as they traveled across the state to see him. In the 2020 indictment, prosecutors said between 1993 and 2012, Hadden sexually abused “dozens of female patients, many of them minors.”
In addition to the four victims who had traveled to New York City to visit from as far away as Nevada, five other women who claimed to have been abused by Hadden were also heard by the jury, along with a nurse and a former medical assistant who claimed to have witnessed more assaults.
Berman claimed on Monday that all 40 victims had “credible” evidence. He added that a pre-sentence study from the US probation office pegged the total number of possible victims “at least around 245”.
Berman suggested significantly more jail time than the roughly five-year sentence that sentencing guidelines recommend due to Hadden’s “multiple” history of abuse, which he describes as possibly dating back to the 1980s, and his vulnerable patients, most of whom are pregnant.
Hadden spent most of the nearly four-hour sentencing, crouched, face down in his palms while wearing his beige prison uniform. In two different courtrooms, a large crowd of many of his former patients was observed. Some of them were moved to tears as Berman described Hadden’s brutality.
In court filings, the prosecution asked for 25 years, while the defense team argued for three years.
The jurors heard testimony from women who had been Hadden’s patients for a long time during the trial. They talked about how they trusted him to guide them through pregnancy and other problems, as well as the times when that trust was irretrievably betrayed.
Many people assume that Hadden often appears to be finishing an exam only to come back as soon as the nurse leaves the room and say he wants to check on something else.
Former patients reported that at these times, he would pretend to be examining them while sticking his tongue or bare fingers into their vaginas or fondling them for a few minutes.
One woman recalls the horror she felt when Hadden instructed, “Stay there for a minute,” shortly after a nurse left the room. She said she was worried that he was looking at a medical problem and that she believed “Oh my, something must be wrong.”
I noticed and trusted him. She added: “I trusted him, and then he took off his gloves and hit me with his fists and mouth.
“How the hell did I get out of here is all I can think of. I have to leave this place,” she declared.
Attorney Anthony DiPietro praised the survivors who came forward and said he had successfully defended dozens of Hadden’s former patients in the case against Columbia University.
DiPietro commented: “You have really done for that organization something they have repeatedly shown they cannot do on their own: get rid of this mass sex abuser.
If it hasn’t happened yet, I hope that today will be the beginning of the transition from survival to healing and adulthood for all of you who have come into contact with this predator.
In opening remarks, the defense did not deny Hadden’s assault on women, saying that “the harm they suffered was real and in some cases very crude.” Hadden’s attorneys disagreed that prosecutors could prove that Hadden convinced the women to cross the state border.
Deirdre von Dornum, Hadden’s attorney, claimed that the two women at the center of the matter made an appointment to see Hadden.
She said during the trial in January, “Return him, condemn him, don’t convict him of a crime he didn’t commit.”
She objected to the length of the sentence Berman proposed on Monday, claiming that the judge relied only on the verdict of two witnesses when adding up the scores of victims he took into account.
Hadden previously pleaded guilty to two New York State charges of third-degree criminal sexual conduct and coercive conduct in 2016. More than 200 of his former patients have reached settlements in legal battles with Columbia University, totaling more than $230 million. The charges against him are at the heart of efforts to push through the New York Adult Survivors Act, which went into effect in November and gives survivors of sexual abuse a one-year chance to file lawsuits that would otherwise be barred by statute of limitations.
A representative for Columbia University Irving Medical Center said in a statement to CBS News that the facility is “deeply sorry for the pain Robert Hadden’s patients suffered and his abuse of their trust.”
The spokesperson stated that Hadden’s prosecution, which led to his conviction on federal charges, “shows how he knowingly worked to evade our surveillance and create situations to abuse his patients.” “We welcome all of the women who have come forward, especially those who have openly shared their experiences in these judicial proceedings,” the statement read.
Hadden has denied all of the claims and charges outside of the two charges he pleaded guilty to in 2016. Hadden was classified as a sex offender at the lowest level under that agreement, which means he didn’t have to go to jail and wasn’t placed on New York State’s online sex offenders list.
Manhattan District Attorney Ends Further Investigations into Hadden and Columbia University
Evelyn Yang, whose husband Andrew is a presidential candidate, gained renewed attention in January 2020 when she claimed in an interview that Hadden abused her.
A few weeks later, the Manhattan District Attorney’s Office announced that prosecutors had been tasked with looking into further charges against Hadden.
The office is looking into how Columbia University handled cases involving Hadden, according to a CBS News article from September 2020. The investigation was ongoing as recently as October of last year.
Both investigations are now closed, a spokesman for the office announced Monday.
The office concluded that any potential criminal charges were barred under the statute of limitations after a thorough examination was carried out under the supervision of the top leadership of the Main Economic Crimes Bureau and our Sex Crimes Unit, the spokesperson added.
