I believe most of us were shocked to discover how much control governors and officials really had over our lives as the pandemic spread two years ago.
According to Walter Olson, a legal scholar at the Cato Institute, the Constitution gives the executive branch and states broad capacity to respond to threats to public safety, but such powers is said to have a time limit. At the time, he declared: “When the state of emergency is over, the government must store these dangerous weapons.”
Developing government threatens freedom
That was stuck in my mind. Because everyone who watches government knows that once that government craves more power, it usually doesn’t give it up.
I spoke with Kimberley Strassel, Wall Street Journal opinion columnist, last week while she was in Grand Rapids attending a Mackinac Center for Public Policy event. She is a keen observer of the government. She claims that the uncontrolled growth of bureaucracy poses a serious threat to our freedoms.

She considers Michigan to be one of the worst states because of excessive government intervention during the COVID pandemic. Until her emergency powers were found unconstitutional for much of 2020, Governor Gretchen Whitmer ruled the state unilaterally. Then she went to the state health department to issue essentially identical directives.
Recall that just a year ago, Michigan workplace inspectors were drafting enduring regulations requiring mask wearing and other safety precautions on an ongoing basis. Thankfully, those who were abandoned.

At the federal level, overreach is even more apparent. It also started before the current administration. To bypass Congress and build his wall, former president Donald Trump exceeded his authority in 2019 when he declared a national emergency at the border. That set a dangerous precedent for the emergency rule.

That is a good thing because the administrative state was sparked by the reluctance of the courts to maintain the separation of powers. Our current predicament is the result of it combined with Congress’s unwillingness to do anything other than pass massive spending packages.
