Heidi Yates, Commissioner for Victims of Crime ACT, said she had “carefully considered” [her] responsibility” to Brittany Higgins when she decided to accompany Ms. Higgins to court every day during Bruce Lehrmann’s trial.
Ms Yates told the Board of Inquiry on Thursday, June 1, that allegations made after the trial that it was wrong for her to be the “face of public support” had “made her very worry”.
She said, “I stress that, in my opinion, those concerns may reflect a misunderstanding of my function in the legal system.
Ms. Yates testified to the investigation that she was required to assist the complainant as a VCC while recognizing the defendant’s right to a fair trial and presumption of innocence under the Human Rights Act.
Ms Yates “fully acknowledged that possibility” when asked by investigator Walter Sofronoff KC if there were any instances where VCC services “would be at risk of asserting that your customer was in fact a victim” contrary to the law. against the complainant no. have met legal requirements and are eligible for support services.

Ms Yates also informed the inquest that she had sought permission from police and DPP Shane Drumgold on a number of occasions, including initially asking verbally and via email to Detective Inspector Marcus Boorman about whether she have been named Ms. Higgins’ contact with the police. Mr Drumgold, with whom she also spoke of her choice to walk into the courtroom with Ms Higgins, expressed no concern about it.
Erin Longbottom KC, the attorney assisting with the investigation, asked Ms Yates whether she would choose to take part in a public trial with Ms Higgins again if she had hindsight.
“It’s hard to say if I would have chosen otherwise if I could go back in time and think about what happened. I am certain that, based on the information I had at the time, I made a reasonable choice considering all the factors that I had to consider,” she retorted.
Are there any lessons to be learned from this case regarding the possibility that my intentions to get past her without being noticed might not have been obvious? Yes, yes, and I would definitely take that into account if a victim asks me to be with them in the future.
