Princess Diana, Meghan Markle and Johnny Depp are former clients of David Sherborne. He is currently leading the legal team fighting the Associated Newspaper Limited (ANL), the company that publishes the Daily Mail and Sunday Mail, at the Supreme Court.
Along with Baroness Doreen Lawrence, Liz Hurley, Sadie Frost, Sir Elton John, David Furnish and Sir Simon Hughes, Harry, Duke of Sussex, is suing ANL for allegedly engaging in illegal intelligence gathering arrests. beginning in 1993.
A series of ledgers was given to the Leveson Inquiry into journalistic standards in 2012, and it is believed that payment evidence to private investigators was a key factor in the legal dispute.
The source of the leaked notes, Mr. Sherborne, who served as an attorney in the investigation and signed a confidentiality agreement on the document, disclaimed responsibility in court on Tuesday morning. He informed the court that none of the three signatories were currently members of the plaintiffs’ group as the means by which the documents in this case reached the plaintiffs’ attorneys.
ANL states that the provisions of the Leveson Inquiry, which can only be changed by a government minister, have ensured the confidentiality of evidence and should therefore be excluded from the privacy dispute.
However, Mr Sherborne argued that investigators did not have a “super-additional mandate” to monitor any activity using the same material that they observed by unrelated third parties. He stated that if the information were made public through another medium, it could still be lawfully used in civil proceedings.
Hurley, Sir Elton and Furnish were all “close friends of Hugh Grant, a core participant in the Leveson Inquiry,” according to ANL’s written submissions to the court. Additionally, Baroness Lawrence is “linked” to DCI Clive Driscoll, another witness to the Leveson Inquiry.
On Monday, the publisher is said to have written a press release explicitly linking Mr Sherborne to his participation in the Inquiry. The ANL asserts that the evidence is “protected by order of Lord Justice Leveson” and that it is now too late to pursue a legal claim.
According to the report, there is a great deal of “information” about past activities at the Mail newspapers in the public domain and Mr Sherborne himself testified to the Inquiry more than ten years ago that the purchase of personal information was “common throughout the Fleet. Street” and that ANL was a “specific offender” [which was] headboard.”
The ANL argued that the claims could have been lawfully made within the usual six-year period. Prince Harry sat two rows behind Mr Sherborne as he spent most of the second day of the trial arguing legal arguments.
The recent victory for Coleen Rooney’s legal team in Wagatha Christie’s High Court trial went to the Oxford graduate lawyer, who attended the same school as longtime Daily Mail editor Paul Dacre.
Among his impressive former clients are Harry Styles, Kate Moss, David Beckham, Tony Blair and Sir Paul McCartney. Mr Justice Nicklin stated in his testimony in court that he was “concerned” about who was responsible for maintaining the confidentiality agreements signed during the Leveson Inquiry.
According to him, “basic contract law” states that someone must be able to use his or her authority to enforce a confidentiality agreement in order for the agreement to work.
Now I’m worried about who is responsible for controlling Leveson’s operations, he said, adding, “Who is that person?” He suggested that judicial processes could be suspended until permission was obtained from the government to use such papers as evidence sought.
